If you don't agree with these Terms, please don't use the Site. If you book a session with us, a separate written client services agreement (signed through HoneyBook) governs the actual photography work. These Terms only cover your use of the Site itself.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 18 years old to submit an inquiry, book a consult call, download a lead-magnet resource, or otherwise transact with us through the Site. Minors may browse the Site under the supervision of a parent or guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use — for example, learning about our services, viewing the portfolio, sharing pages with your fiancé, and submitting an inquiry. This license does not include any right to copy, modify, distribute, sell, or otherwise commercialize Site content except as expressly permitted below.

All content on the Site — including photographs, videos, illustrations, graphics, layout, design, written copy, marks, logos, the "Bohde" wordmark, the "We Create The FOMO" slogan, the "Be Too Much" catchphrase, and all related brand assets — is owned by The Bohde Collective or licensed to us, and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
"The Bohde Collective," the Bohde wordmark, "We Create The FOMO," "Be Too Much," and related brand identifiers are trademarks of The Bohde Collective. You may not use them in any way that suggests our endorsement of you or your business without prior written permission.
If you believe content on the Site infringes your copyright, send a notice that includes (i) a description of the copyrighted work, (ii) the URL of the allegedly infringing material, (iii) your contact information, (iv) a statement of good-faith belief that the use is not authorized, (v) a statement under penalty of perjury that the information is accurate and you are authorized to act, and (vi) your physical or electronic signature, to: caity@thebohdecollective.com (subject line "DMCA Notice").
When you send us an inquiry, comment, review, testimonial, photo, or other content ("User Content"), you grant us a worldwide, royalty-free, non-exclusive, transferable, sub-licensable license to use, reproduce, modify, display, and distribute that content for the purposes of operating the business — including responding to your inquiry, sharing testimonials and reviews on the Site or in marketing materials, and improving our services.
You represent that (i) you own or have the right to share the User Content, (ii) it does not violate anyone's rights, and (iii) it does not contain anything unlawful, defamatory, or obscene. We may remove User Content at any time for any reason.
Submitting the inquiry form, booking a consult call, downloading a guide, or otherwise communicating with us through the Site does not create a binding agreement for photography services. We only enter into a client relationship when both parties sign a written client services agreement (typically delivered via HoneyBook) and the retainer is paid. Until then, either party can walk away, dates are not held, and pricing is not locked.
Prices, packages, add-ons, and inclusions shown on the Site are for informational purposes and may change without notice. We honor pricing only as quoted in a signed proposal or client services agreement. Availability of dates is on a first-paid-retainer basis. Travel, taxes, and add-ons may apply.
The Site may link to or embed third-party websites and services — venues, vendors, social platforms, scheduling tools, and so on. We do not control those resources and aren't responsible for their content, accuracy, privacy practices, or terms. Your use of any third-party site is at your own risk and subject to that site's terms.
The site and all content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
Nothing on the Site is intended as legal, financial, or professional advice. The blog, FAQ, planning resources, and lead magnets are informational and based on our experience as wedding photographers — your situation may differ. Always consult appropriate professionals for advice specific to your circumstances.
To the fullest extent permitted by applicable law, in no event will The Bohde Collective, its owners, employees, contractors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or relating to the Site is limited to the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you paid to us in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
You agree to indemnify, defend, and hold harmless The Bohde Collective and its owners, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Site, (ii) your violation of these Terms, (iii) your violation of any third-party right, or (iv) any User Content you submit.
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. The Site is operated from Texas; if you access it from outside Texas, you do so on your own initiative and are responsible for compliance with local laws.
Before filing any claim, please contact us at caity@thebohdecollective.com with the subject "Dispute" and a description of the issue. We'll try in good faith to resolve it within 30 days.
We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be flagged on the Site for a reasonable period. Your continued use of the Site after changes take effect means you accept the updated Terms.
